Terms of Service

1. Accounts & Eligibility

• Minimum age: You must be at least 16 years old (or the age of majority in your jurisdiction) to create an account.
• Accurate information: You agree to provide truthful registration details and keep your contact, billing, and security information current.
• Credentials: You are responsible for safeguarding login credentials and any activity performed under your account.
• Enterprise access: Administrators warrant they are authorized to accept these Terms on behalf of their organization.

2. Service Description

• Client-side workflows: Most viewer and converter operations execute locally. Optional cloud features (share links, collaboration, CDN optimization) require temporary uploads.
• Beta features: Experimental capabilities may be labeled “Beta” or “Preview” and are provided without guarantee.
• Updates: We may improve, modify, or discontinue features to enhance performance or security. Material changes will be communicated to affected users.

3. 3D Content & Intellectual Property

• Your ownership: You retain rights to 3D models, textures, annotations, and other content you upload.
• License to us: You grant 3D Model Studio a limited, revocable, worldwide license to host, process, transmit, and display your content solely to deliver platform functionality.
• Content obligations: You are responsible for ensuring your uploads do not infringe third-party rights, contain malicious code, or violate export controls.
• Feedback: Suggestions regarding the Platform may be used by us without obligation to you.

4. Acceptable Use

• Do not attempt to probe, scan, or breach the security of our infrastructure.
• Do not distribute malware, spyware, or unauthorized credential harvesting tools.
• Do not upload unlawful, defamatory, obscene, or hateful content, or content that violates privacy or intellectual property laws.
• Do not misuse share links or embed codes to spam or deceive end users.
• Use automated scripts or bots only when expressly permitted via documented APIs.

5. Subscriptions, Billing & Taxes

• Plans: Free and paid tiers are documented on our pricing page. Paid subscriptions renew automatically unless cancelled before the renewal date.
• Payments: Fees are processed by Stripe or Paddle. You authorize recurring charges until you downgrade or cancel.
• Refunds: We issue refunds only when required by law or as stated in our refund policy.
• Taxes: You are responsible for applicable sales, VAT, GST, or withholding taxes unless we are required to collect them.

6. Suspension & Termination

• We may suspend or terminate access for violations of these Terms, suspected fraud, or security risks.
• You may cancel your account at any time via the dashboard or by contacting support.
• Upon termination, hosted 3D files and related data will be deleted per our privacy policy unless legal retention obligations apply.

7. Third-Party Services

The Platform may integrate third-party services (e.g., storage providers, analytics, payment processors). Your use of those services is subject to their respective terms and privacy policies.

8. Disclaimers

• The Platform is provided on an “as is” and “as available” basis without warranties of any kind.
• We do not guarantee uninterrupted access, error-free rendering, or compatibility with every device or file format.
• Beta or preview features may contain bugs and are used at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, 3D Model Studio and its affiliates will not be liable for indirect, incidental, consequential, exemplary, or punitive damages, or any loss of profits, revenues, or data arising from your use of the Platform. Our aggregate liability shall not exceed the greater of (a) amounts paid in the preceding twelve months or (b) USD $100.

10. Indemnification

You agree to indemnify and hold harmless 3D Model Studio, its affiliates, directors, employees, and partners from any claims, damages, or expenses arising out of your content, your use of the Platform, or your violation of these Terms.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Oregon, USA, without regard to conflict of law principles. Any disputes will be resolved exclusively in the state or federal courts located in Multnomah County, Oregon. You consent to personal jurisdiction and venue in those courts.

12. Changes to These Terms

We may update these Terms to reflect new features, regulatory changes, or business operations. We will notify users of material changes via email or in-product messaging. Continued use after changes take effect constitutes acceptance.
